Intellectual Property Rights Policy

If you believe that African Pride Shop has infringed your intellectual property rights, we encourage you to contact us using the procedure outlined below.


A. PROCEDURE FOR REPORTING INTELLECTUAL PROPERTY INFRINGEMENT

It is our policy to (1) block access to or remove any content (including, without limitation, text, graphics, and photos) (collectively, “Content”) that it believes in good faith to infringe the intellectual property rights of third parties following receipt of a compliant notice; and (2) remove and discontinue service to repeat infringers.

If you believe that Content residing on or accessible through the website constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please send a notice of infringement containing the following information to our team via email at contact@africanpride.co:

  • Identification of the copyrighted work or other intellectual property that you claim has been infringed, including registration numbers if applicable.
  • Identification of the infringing Content, including a description of how the material is being used and the specific URL(s) where the material is located so we may verify its existence.
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement of good faith belief that the disputed use is not authorized by the copyright holder, its agents, or the law.
  • A statement under penalty of perjury that the information provided is accurate and that you are the rights holder or authorized to act on their behalf.
  • An electronic or physical signature of the person authorized to act on behalf of the rights holder.

B. ACTIONS UPON RECEIPT OF NOTIFICATION

Upon receipt of a proper bona fide notice of infringement, African Pride Shop reserves the right to:

  1. Remove or disable access to the infringing material.
  2. Notify the content provider accused of infringement.
  3. Terminate access for repeat offenders.

C. COUNTER-NOTICE PROCEDURE

If we believe the removed Content is not infringing, or that we have the legal right to post and use such Content (including fair use), we will send a counter-notice to the original complaining party. This notice will include:

  • Identification of the removed material and its former location.
  • A statement under penalty of perjury of our good faith belief that the material was removed due to mistake or misidentification.
  • Our contact information and signature.
  • A statement of consent to the jurisdiction of the Federal Court for our judicial district.

If a counter-notice is issued, African Pride Shop may replace or restore the Content in 10 to 14 business days unless the rights owner files a court action against us.

Note: Under Section 512(f) of the DMCA, any person who knowingly misrepresents that Content is infringing may be subject to liability for damages and attorney’s fees.
